Sworn Translators are very often required to do sworn translations of Spanish Judgments of civil proceedings into English. A Spanish Judgment given by a Judge in Spain may have to be enforced in the UK if the defendant or debtor is living and working in the UK or has assets in the UK.
A Spanish Judgment is a very complex legal document and therefore it is paramount that a sworn translator produces the translations.
A Spanish Judgment will confirm:
- Type of Proceedings, Claimant, Defendant, Court, Lawyers and Procuradores Particulars. The role of the Procurador is very important in the Spanish legal system because the Procurador is the legal representative in Court. However there is no equivalent of the Procurador in the English legal system. A Sworn Translator will reflect this in the official translation so that the role of the Procurador is understood. There is no equivalence between the Spanish and English Courts and Tribunals, and the sworn translator will ensure that the role of the Spanish Courts and Tribunals is understood.
- Facts in issue. They are the main facts to be established.
- Legal grounds. The Legal reasons for the decision.
- Decision. The Judge’s ruling.
Sworn translators have to be familiar with the two legal systems involved and master their legal terminology to produce accurate translations. The Spanish and English systems are very different, and the sworn translator will act as an expert in Comparative Law.
An accurate sworn translation must be submitted so that the Judgment is properly enforced.
Traducciones Juradas de Sentencias Españolas
Los traductores jurados, constantemente, está haciendo traducciones juradas de sentencias españolas, dictadas en procedimientos civiles, al inglés.
Será necesario presentar la traducción jurada de una sentencia dictada por un juez español si la sentencia se tiene que ejecutar en el Reino Unido. Por ejemplo, puede ser que el demandado o deudor viva y trabaje en el Reino Unido o tenga bienes en el Reino Unido.
La sentencia española es un documento jurídico muy complejo y, por lo tanto, es esencial que un traductor jurado haga las traducciones.
La Sentencia española confirmará:
- Información relativa al Tipo de Procedimientos, Demandante, Demandado, Juzgado o Tribunal, Abogados y Procuradores. El papel del Procurador es muy importante en el ordenamiento jurídico español ya que el Procurador actúa como representante legal ante los tribunales. Sin embargo no hay equivalente de este profesional en el ordenamiento jurídico inglés. El Traductor Jurado reflejará esto en la traducción jurada para que así se entienda el papel del Procurador. Tampoco existe equivalencia entre los Juzgados y Tribunales en España y en el Reino Unido. El traductor jurado se asegurará de que se entiende el papel de los Juzgados y Tribunales españoles.

Los Traductores Jurados están muy familiarizados con los dos ordenamientos jurídicos y con la terminología jurídica para así producir traducciones correctas. Los ordenamientos jurídicos español e inglés son muy diferentes. El Traductor Jurado actuará como un experto en Derecho Comparado.
