Sworn translators normally have to translate a document called Escritura de Aceptación y Adjudicación de la Herencia, Deed of Distribution and Acceptance of Inheritance, when dealing with sworn translations of Spanish probate documentation. This Deed is signed by the beneficiaries or their representatives before a Notary. By virtue of this Deed, the beneficiaries accept the inheritance in Spain.
This document will confirm:
- The particulars of the deceased
- The particulars of the beneficiaries
- A description of the assets in Spain and their value
The relevant documents such as the death certificate, Grant of Probate, Will, Spanish property and bank account particulars… will be enclosed with the Deed.
This Deed is a very complex legal document. There is not an equivalent of this document in the English legal system. However, its sworn translation into Spanish may be needed to prove that the Spanish probate of a British citizen has been dealt with and to prove the source of certain assets, distributed to the beneficiaries.
A sworn translator is very familiar with the two legal systems involved (Spanish and English) and therefore the translator will produce a legal translation to be accepted by the British authorities.
Traducción Jurada de la Escritura de Aceptación y Adjudicación de la Herencia
Los traductores jurados normalmente tienen que traducir un documento que se llama Escritura de Aceptación y Adjudicación de la Herenciacuando están trabajando con documentación testamentaria española.
Esta escritura la firman los beneficiarios (herederos) o sus representantes delante de un Notario. Por virtud de esta Escritura, los beneficiarios aceptan la herencia en España.
Este documento confirmará:
- Los particulares del fallecido
- Los particulares de los beneficiarios
- Una descripción de los bienes en España y su valor.
Los documentos relevantes como el certificado de defunción, el Grant of Probate [autorización testamentaria otorgada por el Tribunal de Inglaterra], el testamento, los particulares de la propiedad y la cuenta bancaria en España,… se adjuntarán a la Escritura.
Esta Escritura es un documento legal muy complejo, el cual no tiene equivalente en el ordenamiento jurídico inglés. Sin embargo, puede ser que se necesite su traducción jurada para probar que se ha adjudicado la testamentaría española de un ciudadano británico o el origen de ciertos activos adjudicados a los beneficiarios.
El traductor jurado es un experto en derecho comparado entre los sistemas españoles e ingleses y, por lo tanto, producirá una traducción jurada que las autoridades británicas aceptarán.
