Sworn translators very often have to translate an English Deed of Change of Name (Deed Poll) into Spanish.
The person who signs this document renounces the use of his/her former name and assumes a new name.
A sworn translation of the English Deed Poll into Spanish will be necessary, for example:
- If a British citizen is a beneficiary of an English Will disposing of assets in Spain and is mentioned with the former name in the Will or
- If a British citizen is selling a property in Spain but the property is registered in the former name.
There is not an equivalent document of the Deed Poll in Spain. In general, the change of name in Spain is a more complex process.
Therefore, it is very important that a sworn translator who is an expert in legal terminology produces the translation. The sworn translator is also familiar with the two legal systems involved (Spanish and English).
A sworn translation of the Deed Poll will have to be submitted together with the original document to the Spanish Authorities to prove the change of name.
Traducción Jurada de una Escritura de Cambio de Nombre (Escritura de Declaración Unilateral)
A menudo, los traductores jurados tienen que traducir Escrituras de Cambio de Nombre (Escrituras de Declaración Unilateral) inglesas a español.
La persona que firma este documento renuncia al uso de su nombre anterior y asume un nombre nuevo.
La traducción jurada de la Escritura de Declaración Unilateral será necesaria, por ejemplo:
Si un ciudadano británico es el heredero de un testamento inglés que dispone de bienes en España, pero se le menciona con su nombre anterior o
Si un ciudadano británico va a vender su propiedad en España pero está registrada con su nombre anterior.
No hay un documento equivalente a la Escritura de Declaración Unilateral en España. En términos generales, el cambio de nombre en España es un proceso más complejo.
Es muy importante que un traductor jurado haga la traducción. El traductor jurado es un experto en terminología jurídica y en las similitudes y diferencias entre los dos ordenamientos jurídicos (inglés y español).
La traducción jurada de la Escritura se tendrá que remitir junto con el documento original a las autoridades españolas para acreditar el cambio de nombre.
