Talking about what will happen in the event of your death with your loved ones is always a tricky and difficult conversation.

That discussion can be further complicated when a person has found love in later life and wants to ensure that their partner and their adult children are looked after. We can help you to ensure that your partner and adult children are looked after, and that your wishes are met, when you die.

On death, a person’s assets are primarily left according to their Will. Where there is not a Will, that person’s assets are left according to the intestacy rules. It is therefore important that expert advice is taken so that you can ensure that your wishes are met upon your death.

It may be, for example, that you wish to allow your partner to remain living in your home after you die and you want your children to only be able to sell the property after the death of your partner. It may be that you want your partner to receive something in your Will, with the remainder of your assets being left to your children. We can make sure that your intentions are properly achieved.

Many people are not aware that marriage automatically cancels any existing Will. So even if you want the provisions in your Will to remain the same, you will need to prepare a new Will if you marry.

It is also important to obtain advice about what insurance policies would best protect your partner and adult children when you die.

You should also think about what might happen if you are unable to make decisions for yourself as you get older. Your partner and your adult children may disagree about who should make health and welfare decisions about you, or who should manage your finances. A Lasting Power of Attorney can be put in place so that you can identify who should make financial and/or health & welfare decisions on your behalf should you be unable to do so in future.
